Ombudsman conducts compensation proceedings against family members of victims of Borba
As head of the independent State body that defends citizens’ rights, the Ombudsman, Maria Lúcia Amaral, accepted the request of the prime minister to lead the process of compensation to the families of the five mortal victims of the collapse of the Municipal Road 255 , in the borough of Borba.
As a result of this decision, the Extraordinary Council of Ministers resolution of December 27, 2018, which approved an "extrajudicial mechanism of voluntary adherence, for the determination and speedy payment of damages, non-patrimonial and property damage, for the death of the victims, their relatives, heirs and other holders of the right to compensation. "
The resolution gives the Ombudsman the task of setting the deadlines and procedures for claiming damages and determining the amount to be paid in each individual case.
Unlike in the case of compensation for the great fires of 2017, also conducted by this State body, it will also be for the Ombudsman to establish in advance the criteria for compensation to the families of the victims of the collapse in Borba, which should be completed by January 31, 2019.
The Ombudsman will then publicly establish and announce the deadlines for the submission of applications and the procedures necessary for the holders of the right to compensation to be able to exercise them.
